What is Bankruptcy?

Personal Bankruptcy in Massachusetts
If your debts are mostly personal debts, in most cases you and our spouse will file under either Chapter 7 or Chapter 13 Bankruptcy.

The assets that you get to keep are known as "exempt"; meaning they are exempt from seizure. Unless you own luxury items such as boats, or vacation homes, most likely all of your assets are exempt and you will not have to surrender any property.
- Chapter 13 Bankruptcy is known as a "reorganization". In a chapter 13 an individual or married couple who have sufficient disposable income will repay a portion of their debt over the course of 3-5 years. In certain situations a Chapter 13 is also used to allow a homeowner to stop a foreclosure and repay their arrears on their mortgage over 3-5 years.

Business Bankruptcy in Massachusetts
Massachusetts businesses who need relief from their debts have the option of filing either a Chapter 7 or Chapter 11. Under a Business Chapter 7 the business sells all of its assets (or "liquidated") . The funds from the liquidation are then used to repay creditors. Any funds remaining after the creditors are paid is then disbursed to the business owners. After the liquidation, the business closes and stops all operation.
In a Chapter 11, the business continues to operate while the business debts and contracts are "reorganized" to allow the business to return to profitability.
